A day may come when you are no longer able to make your own decisions. About your finances, your home, or who will help you with daily affairs. It's not a pleasant thought — and precisely for that reason, it's a thought we often avoid.

But that's also why the fremtidsfullmakt (enduring power of attorney) exists. It's perhaps the simplest and most crucial legal document you can create while you are of sound mind: a document that states who shall act on your behalf, should you someday be unable to do so yourself.
Without it, the decision falls to the state administrator (statsforvalteren), who appoints a guardian. The guardian is often a stranger. With a fremtidsfullmakt, you choose for yourself.
What a Fremtidsfullmakt Actually Is
A regular power of attorney ceases to be valid the moment you lose the capacity to understand what you are delegating. This is logical — a power of attorney is based on what you intend now. But it creates a void: precisely when you need someone the most, the power of attorney lapses.
The fremtidsfullmakt resolves this. It is regulated by chapter 10 of vergemålsloven (the Norwegian Guardianship Act), §§ 78–94, and its core is a special type of power of attorney designed to become effective only when you are no longer able to safeguard your own interests — due to mental illness, including dementia, or serious impairment of health.
You decide who the attorney-in-fact (fullmektig) should be. You determine what he or she shall be empowered to do. And you decide all of this while you still have full clarity.
What the Power of Attorney Can Cover
The fremtidsfullmakt can encompass both financial and personal matters. You can choose one part, or both. Examples of what can be included:
Financial:
- pay bills and manage bank accounts
- sell or rent out property
- manage stocks, funds, and other securities
- receive pensions and social security benefits
- give gifts, within what you have specified (the fullmektig may give customary gifts on your behalf; gifts beyond that can only be given if specifically authorized in the power of attorney)
Personal Matters:
- represent you before public agencies
- make decisions about where you shall live (but not decisions about medical treatment — that is regulated by other legislation)
- apply for a nursing home placement, or change family doctor
- safeguard wishes about how you wish to live your daily life
The fremtidsfullmakt cannot be used to consent to medical treatment on your behalf. For that, the Patient and User Rights Act (pasient- og brukerrettighetsloven) applies, and in practice, the nearest relative will often have a role. Formal Requirements: What Must Be in Place
The fremtidsfullmakt has strict formal requirements — the same as for a will — because it must withstand scrutiny after you are no longer able to confirm it. According to vergemålsloven § 81, the power of attorney must:
- be in writing
- clearly state that it is a fremtidsfullmakt, and what it shall cover
- be signed by you (the grantor) — or you must acknowledge your signature — while the witnesses are present
- be witnessed by two witnesses you have accepted, who are present simultaneously, and who know that they are witnessing a fremtidsfullmakt
- the witnesses must be of legal age (18), have the capacity to understand the significance of the act, and cannot be the fullmektig personally, the fullmektig's spouse or cohabitant, or the fullmektig's parents, children or grandchildren
You must also be of legal age and have the capacity to understand the significance of the power of attorney at the time you sign. In practice, this means: the earlier you do it, the more secure it is.
The document should also be dated, and the witnesses should confirm in writing on the document that you created it of your own free will and understood its significance, along with their own dates of birth and addresses. These additions are recommendations rather than validity requirements — but they can be decisive if doubt is later raised.
When Does the Power of Attorney Become Effective?
The power of attorney exists from when it is signed and witnessed — but it becomes effective (§ 83) only when you are no longer able to safeguard your interests in the areas it covers. It is the fullmektig who must take a position on when that point has been reached, normally supported by a medical certificate — and it is wise to write into the power of attorney that one shall be obtained.
When the power of attorney takes effect, the fullmektig has a statutory duty to notify you and your spouse or cohabitant (or, if you have neither, other close relatives) that it has entered into force and what it contains.
The fullmektig can then ask statsforvalteren to formally confirm the entry into force (stadfesting, § 84). This requires submitting the original power of attorney, proof that relatives have been notified, and a medical certificate on your current condition — which the fullmektig may obtain notwithstanding confidentiality rules. Confirmation is not a validity requirement, but in practice it is the document that opens doors: the land registry (Kartverket) requires stadfesting for any transfer of your real estate, and many banks ask for it.
Regular Power of Attorney + Fremtidsfullmakt = Full Coverage
A useful approach: combine a regular power of attorney (which is effective now, while you are of sound mind) with a fremtidsfullmakt (which takes over when you are no longer able). This allows the person you trust to gradually assist you — with paying bills, arranging practical matters — without any legal discontinuity should your health fail. Many create both documents simultaneously.
Revocation: You Have Full Control As Long As You Can
As long as you are able to understand the significance of doing so, you can revoke the fremtidsfullmakt at any time (§ 89). Revocation happens by demanding the document back from the fullmektig or having it destroyed — and it is wise to also notify any banks or institutions that have received a copy. A promise never to revoke a fremtidsfullmakt is not binding. If the power of attorney has already entered into force and been confirmed by statsforvalteren, statsforvalteren should also be notified.
You can also amend the power of attorney by writing a new one — the newest one, created with the correct formal requirements, will apply.
When Should You Create a Fremtidsfullmakt?
The simple answer: now, while there is no rush.
Fremtidsfullmakter created after the first signs of cognitive impairment have appeared are often contested — because doubt can then be raised about whether you truly understood what you were signing. If you create it in your forties or fifties, while everything is fine, it is legally solid and easy to update later.
Note also that Norway currently has no public register or depository for fremtidsfullmakter. The original paper document is the power of attorney — keep it where your fullmektig can find it, and make sure they know it exists.
As with a will: reread it once a year. Changed life circumstances — divorce, death, a new relationship — are good reasons to revise it.
